This drill has a nice, sturdy feel to it and I can tell it has good torque, when the battery is working. I had initially thought of returning it, but for this great of a price, I decided to diagnose what was wrong myself. Thankfully there is nothing wrong with the drill.The problem is with the battery "protection" board. When you try to run the drill off the battery in the normal way, it will only run for about 3 seconds before it goes into shutdown mode. I opened up the battery and bypassed the protection circuit board inside by clipping onto the +/- directly from the battery bank, and the drill worked perfectly. So basically there is a problem with the circuit board inside the battery. These boards are easily replaced/upgraded with DIY boards you can find all over the web, so it's worth a little DIY effort to get a great drill up and running. I wouldn't recommend getting any batteries of the style that came with this drill (it seems to be a generic 18v Lithium that several brands have used. The DEWALT DCD771C2 battery looks nearly identical and is no doubt the same inside. Not surprisingly, there have been a lot of complaints about the same problem with that product).
